A High Court Judge has banned the use of alcoblow test on motorists suspected to be driving under the influence of alcohol.

Justice J.X Ogolla on Friday ruled that the gadgets used in the drunk-driving operations across the country were faulty and could not be relied on to give accurate readings on the amount of alcohol consumed by those targeted in the tests.

In his ruling at the Kibera Law Courts, the Judge ordered for an immediate refund to motorists who were nabbed in the operations.

The order will include all motorists arrested during swoops conducted in December 2016.

The Judge made the ruling in a petition filed by Nairobi West Bar Owners Group that protested at the harassment of their client during the night swoops.

LANDMARK RULING

In his landmark ruling, the Judge ordered all affected motorists to show proof of payment of the fines imposed on them in the operations and seek refunds.

The National Transport and Safety Authority (NTSA) told Nairobi News that they are studying the ruling, but will in the interim comply with the order.

The authority said they have contacted the European manufactuer of the gadgets to determine the veracity of claims that they were faulty.

The batches being targeted are those used in the swoops during the festive period in Nairobi.
